Abstrak
Hubungan hukum dalam ketenagakerjaan tidak akan menjadi konflik jika pihak debitur memenuhi kewajiban untuk melakukan pembayaran upah dengan tepat waktu serta sesuai dengan kewajiban yang harus dibayarkan. Tetapi kadang karena alasan krisis atau keadaan tertentu menyebabkan pihak debitur tidak dapat memenuhi kewajiban tepat waktu atau hingga tidak mampu memenuhi kewajiban pembayaran utang. Akibat dari ketidakmampuan debitur atau keadaan cedera janji dalam memenuhi kewajibannya menimbulkan tuntutan berupa pengajuan gugatan kepailitan oleh pihak kreditur. Permasalahan yang diajukan dalam tulisan ini adalah bagaimana Implementasi Pembayaran Upah Pekerja pada Perusahaan yang Mengalami Pailit yaitu PT. Istaka Karya sesuai dengan Putusan Mahkamah Agung RI No.124/K/Pdt.Sus/2011. Berdasarkan permasalahan yang ada dapat diambil pembahasan bahwa: pertama, Pembayaran upah pekerja atau buruh termasuk kategori sebagai hak istimewa umum, sehingga pekerja atau buruh dikategorikan kreditor preferen karena memiliki hak istimewa dari undang-undang, dan kedua, Hubungan antara pengusaha dengan pekerja atau buruh adalah hubungan subordinasi, artinya adalah antara pengusaha dengan pekerja atau buruh mempunyai kedudukan yang berbeda, dimana salah satu pihak memberikan perintah untuk melakukan suatu pekerjaan sesuai dengan isi perjanjian kerja dan memberikan upah kepada pihak pekerja atau buruh dan pihak lainnya melaksanakan perintah atau yang diperintah untuk melakukan suatu pekerjaan sesuai dengan isi perjanjian kerja dengan menerima upah kerja.

Abstract
Legal relations in employment will not be a conflict if the debtor fulfills the obligation to make wage payments in a timely manner and in accordance with the obligations to be paid. But sometimes for reasons of crisis or certain circumstances cause the debtor to be unable to meet obligations on time or until unable to meet debt repayment obligations. As a result of the inability of the debtor or the circumstances of the promise injury in fulfilling its obligations led to demands in the form of filing bankruptcy lawsuits by creditors. The problem raised in this article is how the Implementation of Worker Wage Payments in Companies That Are Insolvent is PT. Istaka Karya in accordance with the Supreme Court of Indonesia Decision No.124/K/Pdt.Sus/2011. Based on existing problems can be taken the discussion that: first, the payment of wages of workers or workers belongs to the category as a general privilege, so that workers or workers are categorized as preferred creditors because they have privileges from the law, and second, the relationship between employers and workers or workers is a subordinate relationship, meaning that it is between employers with workers or workers have different positions, where one party gives an order to do a job in accordance with the contents of the labor agreement and provides wages to the worker or laborer and the other party carries out the order or is ordered to do a job in accordance with the contents of the labor agreement by receiving labor wages.
